1. About these Terms
These Terms apply when you access or use Saleyard. By creating an account or using an account-only service, you agree to them. If you do not agree, do not create an account or use those services.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights that may apply under the Fair Trading Act 1986 or Consumer Guarantees Act 1993.
2. How the marketplace works
Saleyard provides tools for sellers to publish cattle listings and for buyers to contact sellers. Sellers publish their listings directly. Saleyard is not the buyer, seller, livestock owner, agent, auctioneer, carrier, payment intermediary or a party to a livestock sale arranged through a listing.
A listing is an invitation to contact the seller, not an offer by Saleyard. The buyer and seller decide whether to trade and agree the sale contract, price, settlement, inspection, animal details, loading, pickup, freight and any other terms directly with each other.
Saleyard may use automated validation or leakage checks and may restrict content that appears unsafe or inconsistent with these Terms. That does not mean Saleyard has reviewed, verified, endorsed or guaranteed a listing, seller, buyer or animal.
3. Accounts and security
Provide accurate, current information and keep it updated. Keep your password, sign-in links and device access secure. Do not share an account or use another person's account without authority. Tell us promptly at hello@saleyard.co.nz if you suspect unauthorised access.
You are responsible for activity carried out through your account unless the activity resulted from something Saleyard is responsible for. We may require reasonable checks before restoring access or acting on an account request.
4. Seller responsibilities
If you publish a listing, you must have authority to offer the cattle and must provide information that is accurate, current and not misleading. You are responsible for the listing, photos and other content, and for complying with laws and obligations that apply to the cattle and transaction.
Do not publish unlawful, fraudulent, deceptive, infringing, harmful or abusive content; private information you do not have authority to disclose; malware; or content intended to evade Saleyard's safety or contact controls. Update or end a listing when the cattle are no longer available or material details change.
5. Buyer responsibilities
Before trading, check the seller's identity and authority, cattle ownership and availability, animal description, breed, head count, weight, health status and any other material information. Arrange any inspection you need and agree payment, settlement, pickup, loading and freight directly with the seller.
Weights, market information and seller-supplied details may be approximate. Do not rely on Saleyard as a substitute for your own checks or professional advice.
6. Saleyard Pro
Saleyard Pro costs NZ$29.99 per month, including GST. It renews monthly until cancelled. Stripe processes payment through Stripe-hosted checkout; Saleyard does not receive or store your full card details.
You can cancel through Manage billing in your account, which opens Stripe's customer portal. Cancellation stops renewal and access continues until the end of the paid monthly period. If payment is overdue, Stripe may retry it and access may continue during that retry period.
These Terms do not create an additional change-of-mind refund or proration right. Any refund or remedy required by law remains available. Contact hello@saleyard.co.nz about a billing problem.
7. Your content
You keep ownership of content you submit. You give Saleyard a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and format that content only as reasonably needed to operate and secure the service. While your listing is live, the licence also allows Saleyard to display and promote that listing. Active public display and promotional use under this licence end when you end the listing.
After a listing ends, Saleyard may retain and display it privately in your seller account history. After content is removed, the licence is limited to technical copies reasonably retained for backup, security, dispute or legal purposes. You confirm you have the rights and permissions needed to submit the content. You may delete a draft or end a live listing using the available account tools, subject to the retention practices described in the Privacy Policy.
8. Acceptable use
Do not misuse Saleyard, interfere with its operation or security, scrape or access it by unauthorised automated means, probe for vulnerabilities, impersonate another person, send spam, manipulate listings or enquiries, or use the service to break the law or another person's rights.
We may take reasonable steps to investigate suspected misuse and may restrict or suspend affected content or access where reasonably necessary to protect users, the service or legal rights. Where practicable, we will explain the action and provide a reasonable opportunity to contact us.
9. Market information
Market prices, charts, reports, estimates and other market information are general, indicative information. They may be delayed, incomplete or based on limited observations. They are not an offer, valuation, warranty or financial, legal, veterinary or trading advice. Check the source date, methodology and the information relevant to your transaction.
10. Service availability and responsibility
We aim to provide a reliable service, but do not promise that Saleyard will always be available or error-free. We may maintain, change or withdraw features where reasonably necessary.
To the extent permitted by law, Saleyard is not responsible for a buyer's or seller's conduct, seller-supplied content, the quality or condition of cattle, or the performance of a livestock sale contract. Each party remains responsible for its own decisions and obligations. Nothing in this section limits liability that cannot lawfully be limited.
11. Changes to these Terms
We may update these Terms prospectively to reflect changes to Saleyard, law, security or business practices. We will publish the updated Terms and change the date above. If a change materially affects an existing paid service, we will take reasonable steps to give advance notice. Continued use after the change takes effect means the updated Terms apply from then; changes do not retrospectively rewrite an agreed livestock sale.
12. New Zealand law and disputes
These Terms are governed by New Zealand law. New Zealand courts have non-exclusive jurisdiction, subject to any right you have to bring a claim elsewhere under applicable law.
Please contact hello@saleyard.co.nz first so we can try to resolve a concern fairly. This does not prevent either party from using a court, tribunal, regulator or other remedy available by law.
